Terms of Service

These Terms govern IT consulting, managed services and on-site work provided by TheNetworkGuy209 LLC to residential and business customers throughout California.

1. Acceptance of Terms

By using this website, requesting a quote, scheduling an appointment or accepting services from TheNetworkGuy209 LLC ("we", "us", "the Company"), you agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Services Offered

We provide the following services, subject to availability and scope agreed in writing:

3. Estimates & Pricing

  • All quotes are estimates based on the information available and remain estimates until approved.
  • Conditions discovered on site (inaccessible walls, failing hardware, legacy systems) may change scope and cost.
  • Additional work outside the approved scope requires customer approval before it is performed.
  • Written estimates are valid for 30 days unless stated otherwise.

4. Payment Terms

  • Payment is due upon completion of service unless other terms are agreed in writing.
  • Managed service plans are billed on the recurring schedule stated in the agreement.
  • Larger projects may require a deposit before materials are ordered or work begins.
  • Late payments may incur additional fees, and work may be paused until the account is current.
  • Customer is responsible for costs of collection on past-due balances where permitted by law.

5. Customer Responsibilities

  • Provide safe, timely access to equipment, wiring paths, network closets and work areas.
  • Provide credentials or authorization required to perform the requested work.
  • Maintain valid, legal licenses for all operating systems and software we are asked to service.
  • Back up important data before any service. We may assist, but backup remains the customer's duty.
  • Confirm you own or are authorized to authorize work on the equipment and property involved.

6. Warranty Disclaimer

Services are performed using industry best practices and reasonable professional care. Except as expressly stated in writing, services and deliverables are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

  • We do not guarantee against future hardware failures or component end-of-life.
  • We are not responsible for ISP outages, bandwidth limits or carrier-side issues.
  • We cannot guarantee prevention of all malware, ransomware or phishing incidents.
  • Third-party software, firmware and cloud service behavior is outside our control.
  • Manufacturer warranties on hardware we install are provided by the manufacturer, not by us.

7. Limitation of Liability

To the fullest extent permitted by law, TheNetworkGuy209 LLC is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost business, lost data or downtime, even if advised of the possibility. Our total aggregate liability for any claim is limited to the amount paid by the customer for the specific service giving rise to the claim.

8. Appointment Cancellation

  • Please provide at least 24 hours' notice to cancel or reschedule whenever possible.
  • Repeated no-shows or same-day cancellations may result in a trip or scheduling fee.
  • If we must reschedule, we will contact you as early as possible and prioritize a new slot.

9. Intellectual Property

All website content, logos, graphics, text, documentation, network designs and branding remain the property of TheNetworkGuy209 LLC. You may not copy, reproduce, republish or distribute them without prior written permission.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Joaquin County, California.

11. Changes to Terms

We may update these Terms periodically without prior notice. The "Last Updated" date reflects the current version. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
